In Re: Family Dollar Stores, Inc., Pest Infestation Litigation

Case number 2:22-md-3032 SHL/tmp is the master docket in the Western District of Tennessee (Western Division-Memphis). This matter and all related cases are assigned to the Honorable Sheryl H. Lipman.

Background

These putative class actions arising from an FDA investigation into an alleged rodent infestation at the Family Dollar Distribution Center in West Memphis, Arkansas, in early 2022, and a subsequent voluntary recall by Family Dollar of potentially affected retail products at over 400 stores in six states. The common factual questions include: (1) whether defendants knew or should have known of the alleged rodent infestation; (2) the alleged health and safety risks to consumers; and (3) the proper measure of damages, if any. On June 2, 2022, the United States Judicial Panel for Multidistrict Litigation (JPML) found that actions in this litigation involve common questions of fact. The JPML determined that centralization in the Western District of Tennessee (Western Division-Memphis) will serve the convenience of the parties and witnesses and promote the just and efficient conduct of the litigation. The JPML transferred the matter to the Western District of Tennessee (Western Division-Memphis) and, with the consent of the Court, assigned the cases to the Honorable Judge Sheryl H. Lipman for coordinated or consolidated pretrial proceedings.
